Illinois is a “Fault” State

In Illinois, the individual that was found to be at fault for causing an auto accident is responsible for compensating anyone harmed due to the accident. This system is known as “at fault.” The at-fault driver is responsible for damage to the other party’s vehicle damage and injuries.

The injured person or the person whose vehicle was damaged can handle a claim with his or her insurance company. They can also file a claim with the at-fault driver’s insurance company or file a claim in civil court. If the claim is made against the injured parties insurer, it can pursue compensation from the at-fault driver’s insurer.

Mandatory Auto Insurance in Illinois

Illinois legislation makes it mandatory for vehicle owners to be covered by liability insurance. The minimum coverage in the state is:

  • $25,000 for injury or death of one individual
  • $50,000 total for all injuries or deaths
  • $20,000 property damage

In all cases, the insurance comes into effect when you are deemed to be at fault.

Liability insurance is intended to cover medical bills, property damage and other costs associated with the accident. The minimum coverage is small. It is advisable to carry a higher coverage to protect you in the event the accident is serious and results in significant injuries and damage. Once the limits of your coverage are exhausted, any balance is your responsibility. Purchasing more insurance than just the minimum will protect your assets in the event of a serious accident that results in significant damages.
